Is THCA Flower Legal In The US? State By State Guide

THCA Flower Legality by State (Overview)

Curious whether THCA is legal where you live? Laws change often. Use this page as a general overview and always check your current state and local rules before buying, shipping, or using THCA products.

What Is THCA Flower?

THCA (tetrahydrocannabinolic acid) is a naturally occurring cannabinoid found in raw, unheated cannabis.
It’s the precursor to THC—often called “the raw form of THC.”

Does THCA Flower Get You High?

Short answer: Not in its raw state, yes when heated.

  • Raw THCA ≠ intoxicating. Unheated THCA does not produce a “high.”
  • Heat = decarboxylation. When you smoke, vape, or bake THCA flower, heat triggers decarboxylation, removing a carboxyl group (COOH) and converting THCA → THC, the primary psychoactive compound in cannabis.
  • How it works in the body. After conversion, THC is absorbed (via lungs or gut) and binds to CB1 receptors in the brain, producing intoxicating effects.

How Is THCA Legal in the United States?

The 2018 Farm Bill (Agriculture Improvement Act of 2018) removed hemp from the federal Controlled Substances Act. Federally, “hemp” is cannabis with no more than 0.3% delta-9 THC by dry weight, and the definition includes all parts of the plant and all derivatives/cannabinoids from hemp, if they meet that threshold.

Key implications:

  • Federal baseline. Hemp-derived products that contain ≤ 0.3% delta-9 THC by dry weight are federally lawful.
  • State variations. Many states follow the federal “delta-9 only” threshold. Others apply a “total THC” standard (counting potential THC from THCA after decarboxylation). Some states restrict or ban certain hemp intoxicants altogether.
  • Bottom line. THCA products must come from hemp and comply with all state rules where made, shipped, and received.

Note on testing standards: Some jurisdictions calculate “total THC” using a decarb factor (commonly delta-9 THC + 0.877 × THCA). If the calculated total exceeds 0.3%, the product may be treated as marijuana under that state’s law—even if delta-9 alone is ≤ 0.3%.

State-Specific Regulations (High-Level Guidance)

  • Permissive models: Many states allow hemp-derived products provided delta-9 THC ≤ 0.3% and proper documentation (COAs, licensing) are maintained.
  • “Total THC” states: Some states set limits based on total THC (delta-9 + converted THCA). Products exceeding 0.3% total THC are treated as marijuana in those states.
  • Restrictive models: A few states restrict or prohibit certain hemp intoxicants (including high-THCA items), or limit retail channels, age, packaging, or potency.

Because these rules change often, verify current law in your state and any state you ship to or travel through.

How Much THCA Flower Can I Legally Possess?

It depends on your state.

  • In states that follow the federal hemp definition and do not set specific possession caps for hemp products, there may be no explicit weight limit for compliant hemp.
  • Other states do impose limits (often mirroring medical/recreational cannabis rules) or restrict sales forms, potency, or age.

Always check your state’s active statutes and agency guidance.

FAQ

Do drug tests detect THCA?
Most standard tests screen for THC metabolites (THC-COOH). Because THCA typically converts to THC during heating (or metabolizes after consumption), you may test positive if you use THCA products.

Is THCA legal federally?
Hemp-derived products with ≤ 0.3% delta-9 THC by dry weight are federally lawful under the 2018 Farm Bill. However, some states and agencies apply “total THC” rules or additional restrictions. Always check state law.

What percent of THCA is “high”?
“High” THCA is a relative term. What matters legally is whether your product complies with your state’s delta-9 or total THC threshold. What matters experientially is that heated THCA becomes delta-9 THC, which can be potent.

Is THCA stronger than delta-8?
When heated, THCA converts to delta-9 THC, which generally produces stronger psychoactive effects than delta-8 THC at comparable doses.

How do I know if my THCA product is legal?

  • Confirm it’s hemp-derived.
  • Verify COAs showing delta-9 THC ≤ 0.3% by dry weight (and total THC compliance if your state requires it).
  • Buy from reputable sellers like Rootz Hemp that provide third-party lab testing and clear batch documentation.
  • Follow your state’s packaging, age, and retail rules.

How is THCA “made”?
THCA occurs naturally in raw cannabis. It’s not “made”; it’s produced by the plant and later converts to THC when exposed to heat (or over time via other processes).

Compliance & Shipping Notes

  • Documentation: Keep COAs, licenses, and shipping records with batch/lot identifiers.
  • Interstate transport: The 2018 Farm Bill, Section 10114 protects the transportation of lawful hemp and hemp products through states and tribal territories.
  • Mailing: USPS Publication 52 (§ 453.37) allows mailing of hemp-based products when the mailer complies with federal/state/local law and retains records for at least 2 years.
  • Age & packaging: Follow all state requirements for age restrictions, labeling, child-resistant packaging, and marketing claims.
